Seems as if chapter one can't be removed or has this changed since 2009?

I've just come across this issue myself, so I'm wondering if this is still the case and if anyone knows why. It may not be an issue but I'd still would like to get some info on this subject, why it can't be removed, if that's the case. As you can see in the attached image the options for removing chapters can't be selected when the first chapter is selected.

I know of no issue that it creates nor any need for it to be removed with user control, so yes, chapter 1 still at timecode 0:00:00 in PD18 and PD19.
