A few months back a posted a question about the EULA (End Users License Agreement) of Cyberlinks Power Director 11, which states that by agreeing to their EULA I was agreeing to use the software FOR PERSONAL AND NON
COMMERCIAL USE ONLY.

As I was going to be making a video I wanted to try to sell locally, this really concerned me so I posted to get others opinions. I'm sure most of you remember the conversation. It was eventually tabled pending more clarification from Cyberlink which was supposed to be forthcoming soon as I understood it.

Since no word has been forthcoming, to be safe, after already spending nearly 100.00 to upgrade to Power Director 11 Ultra a couple of months ago, I decided to bite the bullet and paid an additional 165.00 (that included the extended download fee and the 14.95 back up CD) for the upgrade to Power Director 11 Ultimate Suite on the strength of Cyberlink advertising which said this version was for Pro and Commercial Video Production.

And guess what... The EULA STILL SAYS YOU AGREE TO USE THE SOFTWARE FOR PERSONAL AND NON COMMERCIAL USE ONLY

And if you search their site now, it does not say this version is for Pro and Commercial use only. Fortunately the advertising link in my original program still took me to the page that did say that, so I took a screen shot, but will that hold up in court against the current EULA?

I know many of you think I'm just being paranoid, but in this sue happy society, you can't be too careful. I'm sure that's what that poor woman who downloaded a half dozen songs for her son off a sharing site and ultimately was sued for millions thought when she was downloading illegal music.

Why does this have to be so DIFFICULT! I'm just trying to do the right thing by Cyberlink.
