Whilst I am not a lawyer, I know several very well. The following may be of help/interest in making sure you license your music without problems.

General
"Royalty-free is a term employed in negotiating the right to use creative content, such as photographs, video, or music. The term royalty-free means that once the content is licensed under a set of guidelines, the licensee is normally free to use it in perpetuity without paying additional royalty charges............................

Royalty-free does not mean a user is free to take and use whatever content they find available to them. It only refers to a specific licensing contract between two entities. The licensor, usually the content creator, always retains all copyright to the content, including the ability to distribute it, or allow redistribution."

Didn't mean to correct you, Kevin - as you know, I live with a barrister and now certain things rub off - one of which is a really boring tendency to read the small print and pass on the details. It makes life pass much more slowly and, for some reason, dinner party conversations can be quite tedious.

I really should do more things now that all 5 kids have grown up and left home - maybe I could offer a "small print reading service" to other people who have proper things to do??

Not that it matters much, I suppose, one of my youtube videos got copyrighted or whatever the term is but its still up there with an advert next to it, I think.

I do believe one of our mutual friends took on youtube and won with one of his videos??

I suppose it would be interesting to know if FreePlay Music has ever brought a law suit against someone who has used their music in a video posted on the web.

I would imagine it would be a question of scale. If the video was watched 100 times vs. 1,000,000 times and someone connected with Freeplay music decided to sue for violation of the unsigned, yet offended the implied license agreement.

I also wonder if the music from FreePlayMusic was used within the "Fair Use Category" similar to YouTube if it would be allowed? For example, the music was used in a video to demonstrate the creative possibilities of a Video Editing Software for educational purposes only.

I would Love to hear more opinions regarding this subject and I am sure many new members have similar questions.

EDIT: I forgot to mention my Avatars...I noticed them changing without any input on my end...do you suppose there is a gremlin on the loose?

The Fair Use sites all seem to be a little wishy washy. Wiki has this though:

In August 2008 U.S. District Judge Jeremy Fogel of San Jose, California ruled that copyright holders cannot order a deletion of an online file without determining whether that posting reflected "fair use" of the copyrighted material. The case involved Stephanie Lenz, a writer and editor from Gallitzin, Pennsylvania, who made a home video of her 13-month-old son dancing to Prince's song Let's Go Crazy and posted the video on YouTube. Four months later, Universal Music, the owner of the copyright to the song, ordered YouTube to remove the video enforcing the Digital Millennium Copyright Act. Lenz notified YouTube immediately that her video was within the scope of fair use, and demanded that it be restored. YouTube complied after six weeks, not two weeks as required by the Digital Millennium Copyright Act. Lenz then sued Universal Music in California for her legal costs, claiming the music company had acted in bad faith by ordering removal of a video that represented fair-use of the song.[26]

Hi all,

About a year ago, Youtube pulled down 4 of my videos owing to a copyright claim by WMG.
I contested their removal, and within a few days, the videos were restored and have continued to be publically available on my channel.
I posted a little tongue-in-cheek video (back then), about this experience, for anyone who may be interested.

Thanks for adding your story Cranston, as you have had many first hand experiences with YouTube...and that video was one of the VERY first videos that I ever saw of yours .......and then....a friendship developed....

As far as using music that may not be completely legal....I will share a thought and maybe I can finish the story from behind bars if the music police knock on my door.

Many times my ferry passengers ask me if it is "SAFE" to board the ferry when I am running in a nasty storm. I tell them that getting on a 25 Year old Steel boat and having it navigate safely with 1,000 gallons of fuel is taking an "Acceptable Risk"....You are never boarding this vessel with "No Risk", even on a calm and sunny day. So I take my chances with using some music that is on the Acceptable Risk Category.

I would Love to hear more comments!!

There is a band from my home town in Texas that posted some videos of their original music on YouTube. YouTube deleted them for copyright violation. I can't figure out who complained, but it obviously wasn't the band. I don't see using someone else's music to enhance my videos as fair use, but whatever. I find it rare that I agree with court decisions on private rights. __________________________________

Jeff, I've had good luck with the company that supplies the music that comes with PowerDirector, SmartSound.

If you get on their email list you get notice of one or two special sales a month and while I've paid full price ($99.95) for a few of their albums, most I've purchased have been at special sale prices as low as $24.95. Actually one sale had one I purchased for $19.95.

Recently they went to download delivery and now sell single tracks also, even from their newer music. Most features full rich orchestral sound and there is a lot of "mood" setting music. What came with and installed with PD is actually just a light sampling.

The only limitations on use are national TV and nationwide theatre distribution and in those two cases whoever has purchased your production is responsible for negotiating usage fees.

I did not mention Smartsound because I was listing FREE music.
Smartsound is my first choice for music because of variety, quality, and what could be easier than drag n drop?
